Congo’s Business mediation center goes operational

The activities of the Congo Medition and Arbitration Center (Cemaco), a branch of Pointe-Noire, have indeed started, confirmed on August 18, Sylvestre Didier Mavouenzela, President of the Consular Chamber, institution responsible for the operationalization of said center under the PRCCE II launched by the government.

The launch of Cemaco was marked by a training session for arbitrators and mediators which took place from August 12 to 13 at the Chamber of Commerce. The operationalization of Cemaco integrates the second component of the Commercial and Entrepreneurial Capacity Building Program (PRCCE II) launched by the Congolese government with financial support from the European Union (EU). This, in order to respond to the problems and weaknesses identified, by proposing reforms and tools to strengthen the entrepreneurial capacities of the Congolese and improve the business environment.

In this project, the Chamber of Commerce of the Ocean City is involved in the second component focused on improving the business climate with the mission of working for the operationalization of Cemaco, the deployment of a help desk ( help to make information available and offer back office support) and the implementation of an Ohada course for the benefit of small and medium-sized businesses.

The training of arbitrators and mediators launched by Prosper Bizitou, general administrator of Cemaco, made it possible to strengthen the capacities of the participants on the tools and techniques in the conduct of a mediation in accordance with the uniform act of Ohada relating to the right to mediation adopted on November 23, 2017. Practical workshops and exchanges of experience constituted the main part of this training led by two experts, namely Flora Dalmeida Mele, magistrate, former president of the Common Court of Justice and Arbitration based in Abidjan and Médard Désiré Backadi, former director of studies and internships at the Higher Regional School of the Judiciary of Benin.

This activity was the last step in the operationalization of Cemaco. Sylvestre Didier Mavouenzela, satisfied, explained: “We have carried out a lot of important awareness-raising activities to develop arbitration and mediation, a new technique that operators are not necessarily familiar with. In a modern environment, there is also a need for modern justice and arbitration and mediation are modern ways of dealing with disputes between economic operators. It is an institution that our country lacked and it is one more step that has been taken “.

Currently, the Congo has two Cemaco in Brazzaville and Pointe-Noire. The said centers, which are housed in the Chambers of Commerce, are headed by a general administrator and each branch has a directory. Sylvestre Didier Mavouenzela invited economic operators to approach the center. “Today we have all the regulatory and legal framework to be able to take business. We ask traders and businessmen to come to Cemaco to deal with their disputes, ”he said. In the ocean city, the premises of Cemaco are located in the city center at n ° 35 boulevard Charles-de-Gaulle.

The said premises received, on July 13, the visit of the EU Ambassador to Congo, Raul Mateus Paula, who came to inquire about the progress of the project. “The EU is very happy and wishes to support the Congo and the Pointe-Noire Chamber of Commerce in the efforts which will be more and more important in the future to face the brutal crisis but which is also an opportunity to accelerate reforms and allow the Congo to prepare for emergence, ”he said. Note that in Brazzaville, the training of arbitrators and mediators for the operationalization of Cemaco starts on August 19 at the Chamber of Commerce.
