Congo adopts reformed Labour Code

The reform of the Labor Code was completed on December 30. If the social partners had marked time on December 28 on certain points, they finally validated the final version which should be presented to Parliament by the Minister of Labour.

 

The event which started on December 28, the restitution of the work of the reform of the Labor Code to the stakeholders by the Ministry of Labor was completed on December 30, to the satisfaction of the employers and also of the workers who had boycotted the work on December 28. “Monday the 28th, when we got here, there was a stir. We slammed the door to the work because we were surprised when article 92, which speaks of the modification of the contract, had been rejected by all the parties during the different phases of the work ”, explained Jocelyn-Louis Ngoma, Vice- Chairman of the workers’ group of the Commission set up as part of the reform of the Labor Code.

On Tuesday, Minister Madeleine Berre called a clarification meeting. In a participatory and transparent approach, adopted since the beginning of the process of drafting the new code with the involvement of the social partners, it came back to the fact that its arbitration only concerned points of disagreement between employers and workers.

This reassured them and led to a general consensus on December 30. Employers and workers signed the final version of the reform to validate the content before the text is submitted to Parliament. This last step, says the Ministry of Labor, marks the end of the consultation process required by convention number 144 of the International Labor Organization (ILO).

“The final version of the draft Labor Code validated and initialed today which will be introduced into the governmental and parliamentary adoption circuit, incorporates both the recommendations of the social partners, the International Labor Office and the Government’s arbitration”, underlines the Ministry of Labor. The social partners, for their part, expressed their satisfaction with the inclusive, participatory and transparent approach adopted by the Minister of Labor during all stages of the process of adopting this project.
